GENERAL TERMS AND CONDITIONS OF SALE
APPLICABLE SINCE 1 APRIL 2018
These general terms and conditions of sale apply between :

Hereinafter referred to as "the Villa".
And
Any individual or legal entity making a purchase at the Villa's ticket office and on the website www.billetterie.villa-carmignac.com
Hereinafter referred to as "the Buyer".
The present conditions aim to define the terms of sale on site and at a distance between the Villa and the Purchaser from the order, to payment and delivery.
PREAMBLE
Children under the age of 12 who are not accompanied by a person aged 16 or over will not be admitted to the Villa Carmignac.
Villa Carmignac is located in a listed wooded area in the heart of the Port-Cros National Park.
The instructions of the National Park are given below:
A national park is an exceptional territory open to all but which can remain so thanks to the vigilance and respect of each person. The islands of the National Park are protected natural areas. There are therefore specific regulations necessary to preserve this fragile territory, to respect the different users and to prevent risks.
Porquerolles can be discovered by bicycle and on foot. Dogs must be kept on a leash on the paths and trails and are prohibited on the beaches. Do not forget that there are no water points outside the villages.
Dogs are also forbidden on the Villa Carmignac site.
Main regulations in the heart of the park :
- no camping or bivouac,
- Visitors arriving by bicycle must leave their bikes in the car park provided for this purpose. Under no circumstances may they ride their bikes on the Villa Carmignac site.
- no motorised vehicles except for service or authorised vehicles,
- no waste outside the containers so as not to alter the natural environment and landscape,
- no noise or disturbance to preserve the character of the place,
- no weapon, hunting being forbidden,
- no dogs to maintain the tranquillity of the wildlife and the cleanliness of the beaches. In the village of Port-Cros, between the Fort du Moulin and the statue of St Joseph, access for dogs on a leash is allowed,
- no harvesting, nor sampling to conserve biological diversity,
- no fires or cigarettes outside the village to prevent fire and keep the beaches clean.
Definitions
Order: any contract between the Purchaser and the Villa allowing the subscription of one or more products.
Product: constitutes a Product, within the meaning of these general terms and conditions of sale, the sale proposed for an overall price of one or more admissions to the Villa and/or a specific visit with reservation, for a specially determined event, or any other product offered for sale on the site.
Admission tickets sold by the Villa give access to the museum and the gardens.
The Villa does not offer tickets that give exclusive access to the gardens.
CGV: refers to the present general terms and conditions of sale for on-site or online ticket sales.
The CGV govern all the steps required to place the Order and ensure the follow-up of this Order between the contracting parties. The fact of placing an Order implies the Buyer's full and irrevocable adherence to these CGV.
The Purchaser declares that he/she is at least 18 years of age and has the legal capacity or has parental authorisation to place an Order at the various points of sale of the Villa's Products.
The Sale of Individual Tickets
Article 1: The sale of the entrance fee and session activities
1.1. Sale of Entrance Tickets
Access to the entire site is subject to the purchase of a ticket.
Tickets can be ordered online at: www.billetterie.villa-carmignac.com
As the number of visitors is limited to 50 people per half hour, online ticket ordering is only done by time slots, within the limit of available seats. Visitors are requested to present themselves at the entrance to the Villa Carmignac between the time of their reservation and the half hour following.
If the Purchaser does not receive confirmation or cancellation of his/her Order by email within one day, he/she should contact the Villa by email: reservation@villacarmignac.com.
In accordance with the provisions of article L121-21-8 of the Consumer Code, the Buyer does not benefit from the right of withdrawal.
At the ticket office of the Villa
Admission tickets are on sale at the Villa's ticket office as soon as the Villa opens and 2 hours before closing, subject to availability. However, it is strongly recommended to book in advance via the Internet.
1.2. Activities with sessions :
The Order is made by Internet via the following website: www.billetterie.villa-carmignac.com
Sales of tickets for session activities (concerts, shows, individual visits, educational workshops, etc.) are processed within the limit of available seats.
The Order of tickets for session activities is made from the opening date of sale indicated in the calendar on the website. Sales opening dates may be modified by the Villa without prior notice.
If the Purchaser does not receive confirmation or cancellation of his/her Order by email within one day, he/she should contact the Villa by email: reservation@villacarmignac.com.
Session tickets are also on sale at the Villa's ticket office as soon as the Villa opens and up to 2 hours before closing.
Article 2: Prices and payment
2.1 Admission ticket prices and session activities
The prices of admission tickets or session activities are indicated in euros, all taxes included. Tickets remain the property of the Villa until full and final payment has been received.
The Villa reserves the right to modify the prices of admission tickets and session activities at any time. However, these modifications will have no effect on the price of Orders that have been paid in advance. Any method of payment not provided for in these GCS will be refused by the Villa.
2.2 Payment for admission tickets and session activities
For online ticket purchases, only payment by credit card is authorised (Eurocard / Mastercard, Visa Card, JCB Card, Carte Bleue, American Express, Diners Card, Cup Card).
The online purchase of one or more tickets on the www.billetterie.villa-carmignac.com website gives rise to a one-off payment by credit card (Eurocard / Mastercard, Visa Card, JCB Card, Carte Bleue, American Express, Diners Card, Cup Card).
The Villa does not accept payments by bank cheque, bank transfer or holiday vouchers.
The Villa's internet sales platform, operated by See Tickets, uses the secure payment service Payzen (www.payzen.eu) certified to the PCI/DSS standard.
Confidential data (16-digit bank card number, expiry date) is transmitted encrypted by See Tickets to the Payzen payment platform and is not stored but is handled directly by the payment service.
The Villa guarantees that the encryption means and services used to secure transactions have been authorised or declared by the person responsible for encryption, in application of the legislation in force.
The amount of the Order is debited at the time of validation of the payment.
2.3 Payment security
For all payments made for the TICKET(s) order, Villa Carmignac uses the services of Payzen, which uses a secure online payment system that encrypts the Customer's bank card number.
The PAYZEN secure payment solution uses the TLS protocol (encryption of all card-related information) and is subject to numerous approvals (PCI DSS certification, CB Cartes Bancaires approval, Visa Merchant agent approval, etc.).
The Customer's bank details are thus protected as only the payment agreement codes issued by the banks are kept.
The User is informed that the provisions relating to the fraudulent use of his/her Bank Card are those resulting from the agreement concluded between the User and the bank that issued the said Bank Card.
The Sale of Group Visits
Article 3: Booking of group visits
3.1. Booking of group visits
3.1.1. Scope of application of the general terms and conditions of sale
The present general conditions apply to the sale of group visits made at the ticket office after booking by email reservation@villacarmignac.com or by telephone.
The Villa reserves the right to make any changes to the General Terms and Conditions for group visits.
Reservations are processed within the limit of available places.
3.1.2 Group tour booking procedures
If the group consists of less than 10 people, reservations are normally made through the online ticketing system.
For groups of more than 10 people, as the number of visitors is limited to 50 per half hour, the group is asked to reserve one or more slots for itself, depending on its size.
Reservations in this case are made by email: reservation@villacarmignac.com or by telephone on 04 65 65 25 50.
General Terms and Conditions of Sale Applying to All Products
Article 4: modification and cancellation
The Villa reserves the right to modify its cultural offer if all the conditions are not met to offer it as planned.
In the event of cancellation of a service due to the Villa, the value of the ticket price paid by the Purchaser to the Villa will be refunded upon request by the interested party, presented within a maximum period of three months from the date of the scheduled service and upon presentation of the non invalidated ticket and bank details (bank statement), to the exclusion of any other compensation or indemnity whatsoever.
If a sitting activity has to be interrupted beyond half of its duration, the ticket will not be refunded.
In the event of an interruption before half of the duration of the activity or in the event of postponement of an event or in the event of cancellation or modification of an exhibition within the whole of the proposed programme, no refund or compensation may be claimed.
As far as possible, the Villa undertakes to communicate these cancellations or modifications to the Purchasers either by on-site communication or by sending informative messages by email to the address given at the time of purchase.
The Villa undertakes to reply in writing within fifteen (15) days of the date of receipt of the request for reimbursement.
In all cases, only the price of the ticket will be refunded and no expenses of any kind whatsoever will be reimbursed or compensated.
In the event that the purchaser is unable to travel to Porquerolles Island (traffic jams, parking in the car park impossible, saturated access, navigation impossible, without this list being exhaustive), the ticket(s) will not be refunded, but may be modified for a later date of visit during the season only once.
In busy periods, it is therefore strongly recommended, for "outward" transport, to arrive at the Tour Fondue port before 9am or after 1pm or to cross the Villa with the water taxi Contact (+33) 494 58 31 19, available 24 hours a day, 7 days a week, from the Tour Fondue or the Port of Hyères.
Article 5: obtaining tickets
To obtain tickets at a preferential rate, you will need to present the associated proof of purchase.
The tickets are in the format chosen:
- printable by the Purchaser via his/her personal space as soon as the payment of his/her Order has been validated by Internet;
- dematerialised (e-ticket) when downloaded as an image, using a Smartphone.
- issued at the Villa's ticket office when they are purchased on site.
Tickets that can be printed at home are permanently available until the date of the event on the Villa's website.
The home printable ticket allows the Purchaser to print the tickets purchased on an ordinary printer from an internet access. Each ticket is provided as a pdf file.
To be valid, the ticket must be printed without any change in print size on a white A4 sheet, blank on both sides. Each seat purchased corresponds to one ticket.
Tickets that can be printed at home have a unique barcode. The validity of the tickets is checked and registered at the entrance using barcode scanners. It is not possible to be admitted several times with the same ticket. The reproduction of tickets is prohibited and will not give the Buyer any advantage.
Only the first person to present the ticket will be admitted to the museum. This person is presumed to be the legitimate bearer of the ticket. It is therefore forbidden to reproduce, duplicate or forge the ticket in any way, or to make it available for such purposes.
The Villa may refuse entry to the event when several prints, reproductions, copies or imitations of a home printable ticket are in circulation and access to the event has already been previously granted to the holder of a print, reproduction, copy or imitation of the corresponding home printable ticket.
In particular, the Villa is not obliged to check the identity of the person presenting the home-printable ticket in order to ascertain whether this is the Ticket Holder, nor is it obliged to check the authenticity of the home-printable ticket, insofar as the imitation or copy cannot be identified as such beyond doubt when checking entry to the event.
Article 6: Conditions for the use of banknotes
6.1. conditions of use of tickets
Tickets cannot be refunded (particularly in the event of loss or theft) or resold. They may be changed for a later date during the season only once.
Any holder of a ticket acquired within the framework of the Villa's offers is prohibited, under penalty of possible legal proceedings, from using it for any promotional or commercial purposes whatsoever. In particular, unless specifically agreed by the Villa, any sale, resale or exchange of tickets is strictly forbidden, under penalty of the penalties provided for in the Penal Code.
In this respect, the Villa reserves the right to refuse access to the museum to any holder of a ticket acquired from an organisation other than the Villa or any third party duly authorised by it.
The reduction in price may be refused if proof is not presented that the ticket has been purchased at a preferential rate.
6.2. Complaints
All complaints must be made by email reservation@villacarmignac.com
The Purchaser, who is the beneficiary of special conditions of access to the Villa's cultural services in application of agreements between the Villa and a partner (theatre, museum, tourist office, etc.), may under no circumstances claim against the Villa for the failure of the said partner to fulfil its obligations.
For any show ticketing for which the Villa is not the producer, the Buyer must refer to the general terms and conditions of sale of the venue of the event or the producer.
Article 7: personal data
7.1 Personal data when purchasing on the website www.billetterie.villa-carmignac.com
Your personal data is processed in accordance with the "Personal Data Processing Policy".
Article 8: Responsibilities
Neither the Villa, nor the Buyer, shall be held responsible for any non-performance due to a case of force majeure, beyond their control, including but not limited to war, riot, insurrection, strike, lockout, shortage, fire...
Similarly, the Villa shall not be held liable for the use of the Products ordered and delivered, the Buyer being solely responsible for their use by himself or by a third party.
Article 9: Applicable law / settlement of disputes
These general terms and conditions of sale are subject to French law.
In accordance with the provisions of article L133-4 of the Consumer Code, in the event of a dispute that may arise between the Villa and the Purchaser in connection with the execution or interpretation of this contract, the Purchaser shall remain free to refer the matter to a third party mediator or conciliator with a view to reaching an amicable settlement of the said dispute.
Failing amicable settlement, the dispute will be brought before the competent French Courts.
Article 10: modification of the general terms and conditions of sale
The Villa reserves the right to adapt or modify these GTC at any time. In the event of a modification, the GCS in force on the date of the Order will be applied to each Order.
If, for any reason whatsoever, one of these General Terms and Conditions should be declared inapplicable, this inapplicability shall not affect the application of the other provisions of the General Terms and Conditions, the provision deemed inapplicable being replaced by the closest possible provision.
Schedules
Exhibition The Infinite Woman : From 27 April to 3 November, Tuesday to Sunday
2024 season schedules :
- From 10am to 6pm from April to June and from September to November (last admission 4-4.30pm)
- From 10am to 7pm in July and August (last entrance 5pm-5.30pm), extended opening on Thursdays from 10am to 10pm (last entrance 8pm-8.30pm).
Useful information
Dogs are not allowed, except for assistance dog.
Soft shoes are recommended to visit the gardens, you will need to take them off when visiting the building. Exhibitions can be discovered barefoot.
Pushchairs should be left at the entrance of the Villa. They are not allowed inside the building. A front-facing baby carrier may be required. The pushchairs can be retrieved for the garden tour.
Bicycles are not allowed on the site (bicycle parking is available for visitors).
For safety reasons, liquids (water bottles, flasks etc ) and backpacks are not allowed in the indoor areas.
Villa Carmignac is located on a protected site, rich in several rare and sensitive plant species. We ask our visitors to respect the regulations of the Port-Cros National Park, in particular the prohibition of smoking, littering, picnicking or picking plants.
